Illuka Reception Centre for Asylum Applicants

The following rules for Asylum Applicants (Applicants) at the Illuka Reception Centre (the Centre) state the rights and obligations for arrival, provision, and the rules for staying in and staying out at the Centre.

1 Accommodation
1.1 Applicants live in the quarters provided for them; Applicants may not change their rooms without the consent of authorised personnel.
1.2 Authorised personnel may relocate Applicants as required by the Centre.
1.3 Authorised personnel may enter an Applicant’s room without his/her presence or permission if the property of the Centre is in danger or the room is believed to be used in a manner or for a purpose other than that intended by the Centre.
1.4 Preparing food and washing dishes take place in the kitchen only.
1.5 Applicants’ food and dishes are kept in their rooms. Applicants prepare their own meals.

2. Provisions
2.1 Necessities such as food, essentials for maintaining personal hygiene, etc. are supplied to new arrivals at the Centre on the basis of an order by the Manager of the Centre.

3. Absence from the Centre
3.1 Applicants are required to stay at the Centre throughout the night. The time from 22:00 to 6:00 is considered night time.
3.2 An Applicant may be absent from the Centre during the night in the following cases:
1) to get medical assistance
2) to be with a member of their family who is in need of emergency medical attention
3) to stay with a person who is resident in Estonia legally on the basis of that person’s approved application
3.3 Applicants are required to notify the Centre of their absence and must submit a written application to the Manager of the Centre showing: the reason, the place of stay away from the Centre, and the time when the Applicant wishes to be absent. Permission in writing is issued in response to all such successful applications.
3.4 An Applicant who has been absent from the Centre for more than one day (24 hours) and whose whereabouts are unknown is declared ‘wanted’ and the relevant notification submitted to the (immigration) authorities.

4. Visiting
4.1 Guests are received at the Centre from 9:00 to 21:00.
4.2 Minors do not visit the Centre (except for Applicants’ children).
4.3 On arrival at the Centre, at the request of the guard, visitors show their identification documents and name the person they wish to visit.
4.4 The Manager of the Centre may prohibit visiting for reasons such as contagious disease and technical problems.

5. Property
5.1 Applicants are obliged to handle the property of the Centre in a responsible manner and return all things lent to them upon leaving.
5.2 Applicants are obliged to inform Centre personnel of any action taken against property of the Centre or people staying at the Centre.
5.3 The Centre is not responsible for Applicants’ personal property.
5.4 If an Applicant destroys, loses or damages the Centre’s property, he/she is obliged to compensate damage caused.

6. Applicants’ Rights
6.1 Applicants living at the Centre have the right to receive:
1) food or a daily allowance to obtain food not available to the Centre
2) essential clothing and other necessities
3) money for urgent small expenses
4) essential first-aid and medical examination
5) essential translation services and Estonian language instruction
6) information regarding their rights and duties.
6.2 Applicants are entitled to services offered by the Centre until they are granted refugee status, but for no more than four months.
6.3 Applicants who have received a permit issued by the Citizenship and Migration Office to live outside of the Centre, because they have sufficient financial resources are not subject to sub clauses 6.1 (1, 2 and 3).

7. Applicants’ Duties
7.1 Applicants are required to observe the constitutional order of Estonia and to comply with the legislation of Estonia.

7.2 Applicants are required to:
1) wash their bed linen and clean their room regularly
2) switch off lights and electrical equipment when leaving a room
3) help and keep common rooms clean and tidy
4) clean up after preparing food
5) comply with the work and time schedules of the Centre
6) participate in activities organised by the Centre
7) conduct themselves respectfully in their dealings with employees of the Centre
8) follow directions with a legal basis, or made on the basis of internal procedure rules.
7.3 Children are supervised and their parents or guardians ensure their safety.

8 Applicants are prohibited:
8.1 to posses or use alcohol or illegal drugs
8.2 to be intoxicated by alcohol or illegal drugs
8.3 to possess or use firearms and cold steel
8.4 to have or to keep animals
8.5 to talk or play music loudly or pursue other activities which disturb others during the night
8.6 to use the Centre’s business phones and computers
8.7 to make open fires on the territory of the Centre
8.8 to smoke in the rooms or common rooms. Special areas for smoking are provided.

9. Violation of Rules
9.1 Institutions of legal protection are notified of all violations that are in contradiction to the law or cause substantial property damage.
Applicants undertake to comply with these rules by signing the relevant supplementary confirmation.
